2. Service Description
AIBuildr provides managed infrastructure services (IaaS/PaaS)
for deploying open-source applications such as n8n, Flowise, and Qdrant.
Important: AIBuildr is not the owner, creator, nor officially
affiliated with n8n.io, FlowiseAI, or Qdrant Solutions. We offer hosting,
maintenance, and configuration services under their respective open-source
licenses.
3. Billing and Payments
Services are billed through monthly recurring subscriptions via our
secure payment gateway (Stripe).
- Cancellation: Users can cancel their subscription at
any time before the renewal date.
- Trial Period: If a free trial is offered, a valid payment
method will be required.
- Refunds: No refunds are offered for partial unused months,
except for technical errors attributable to AIBuildr.
4. Limitation of Liability
The service is provided "as is". AIBuildr strives to maintain 99.9%
availability but does not guarantee the total absence of technical
interruptions.
AIBuildr is not responsible for:
- Data loss caused by user misuse of tools.
- Indirect damages or lost profits from service interruptions.

Content processed by users through their automation instances.
5. Privacy Policy and Data Protection
We comply with GDPR (General Data Protection Regulation).

- Legal Basis: Contract execution (service provision).
- Recipients: Data will not be shared with third parties,
except for legal obligations or necessary providers (Hetzner, Stripe).

Servers are located in the European Union (Germany/Finland).
6. Usage Limits and Data Policy
6.1. Storage
The service operates under a Fair Use policy. The following total
storage limits (database + files) apply based on your plan:
- Starter Plan: Up to 3 GB.
- Builder Plan: Up to 8 GB.
- Scaler Plan: Up to 15 GB.
If the storage limit is exceeded, AIBuildr reserves the right to
contact the user to resolve the situation or propose a plan upgrade.
6.2. Automatic Data Retention
To ensure optimal instance performance, the system automatically
cleans up old data:
- Execution history (n8n): Records are retained for 14
days.
- WhatsApp messages (Evolution API): Message history is
retained for 30 days.
6.3. Usage Restrictions
The infrastructure is optimized exclusively for running automation
workflows. The following uses are expressly prohibited:

Mass file storage unrelated to automations (e.g., using it as a CDN
or personal cloud).

Cryptocurrency mining or compute-intensive processes unrelated to
the service.

Sending unsolicited communications (SPAM) or any illegal activities.
Violation of these restrictions may result in temporary or permanent suspension
of the service without the right to a refund.
6.4. Backups
AIBuildr performs automatic backups as a preventive measure. However,
full data recovery is not guaranteed in the event of an
incident. It is the user's responsibility to maintain their own copies of
critical information.
6.5. WhatsApp Usage via Evolution API (Baileys mode)
The Baileys mode (QR code connection) uses reverse engineering on the
WhatsApp protocol and is not authorized by Meta/WhatsApp Inc. Its use on AIBuildr infrastructure is strictly limited exclusively to testing and prototyping purposes.
The user acknowledges and agrees that:

Using Baileys in production violates Meta's Terms of Service.

Meta can permanently revoke the associated WhatsApp number,
without prior notice.

AIBuildr is not responsible for the loss of numbers,
accounts, or data resulting from the use of Baileys mode.

If AIBuildr detects abusive use or use that endangers the shared
infrastructure (e.g., abuse reports from Meta affecting server IPs),
we will proceed to immediately suspend the instance without the right to a refund.

The user is solely responsible for complying with the Terms of
Service of the third-party platforms they use.
7. Changes to These Terms
AIBuildr reserves the right to modify these terms at any time. Changes
will be communicated to users via the email address associated with
their account at least 15 days before they take effect.
Continued use of the service after notification will constitute
acceptance of the new terms.
